Cool FM's recorded request show in breach

Cool FM has been found in breach of Ofcom guidelines after the station broadcast a pre-recorded request show and encouraged listeners to get in touch.

The Bauer station received one complaint from a listener who worked out the show wasn’t live when the presenter, Kathryn Wilson, was performing a live DJ set in a local nightclub.
Ofcom listened to the show and also noted Kathryn was encouraging contact from listeners via a premium rate text number, plus Twitter and Facebook. The show was introduced as being live and contained a number of made-up requests and dedications.
Kathryn said: “As always you can tweet me [presenter’s Twitter handle given] or you can find us on [Facebook page given] and as usual, we’re on the text: COOL space and your message [mobile short code given]. All you’ve got to do is leave your name on the end, let us know who you’re with, what you’re up to and of course, what you want to hear.”
Ofcom also noted that the presenter read out what appeared to be requests and contributions from listeners who had contacted the station during the programme; for example:
“Hello and good morning to Simon who requested that one and Matthew, who fancies rocking out this morning. This is the Foo Fighters with Best of You.”
Bauer says it has carried out an internal investigation and worked out this particular show, on April 6th, was an isolated incident. Seven listeners texted in and they have been refunded the 25p they were charged.
